In-N-Out Implements Mask Ban for Employees in Select States, Facing Public Health Concerns

In-N-Out, the popular burger chain, has issued new guidelines that will prohibit employees in Arizona, Colorado, Nevada, Texas, and Utah from wearing masks unless they have a doctor's note, as revealed in internal company emails leaked on social media.


The company memo cited "the importance of customer service and the ability to show our Associates' smiles and other facial features while considering the health and well-being of all individuals" as the reason for the policy change. The new guidelines are set to take effect on August 14 and apply to all In-N-Out employees in the specified states, except for those with job duties requiring masks or protective gear, such as painters. Non-compliance could lead to disciplinary action, including termination. Notably, California and Oregon have laws preventing employers from banning masks.


In the past, In-N-Out has clashed with health experts over safety measures during the COVID-19 pandemic. In 2021, some of its California locations faced fines or temporary closures due to the chain's refusal to enforce COVID-19 vaccination rules.





Public health officials, including infectious disease specialist Dr. Judy Stone, have expressed concerns about the new mask guidelines. Requiring a doctor's note is seen as a burden for many, especially those without access to primary care physicians. Additionally, some argue that demanding proof of a disability might be a potential violation of the Americans with Disabilities Act.


The Centers for Disease Control and Prevention (CDC) data indicates that 6 in 10 adults have chronic diseases, increasing their risk for severe COVID-19. California and Oregon employees will also have new mask guidelines effective August 14, but in contrast to the other states, employees in these regions can choose to wear masks in stores. The company-provided N-95 mask is mandatory for those opting to wear masks, and other masks would require a valid medical note.


In-N-Out stated that its policies are subject to local health regulations, and the company will continue to evaluate accommodations for its guidelines.
